1. Acceptance of Terms
Welcome to ChatterPath ("we," "us," "our," or "ChatterPath"). By accessing or using the ChatterPath application, website, or services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
By creating an account, you represent that:
- You are at least 18 years of age
- You have the legal capacity to enter into these Terms
- You will use the Service in compliance with all applicable laws
- All information you provide is accurate and current
2. Description of Service
ChatterPath is an application and platform that provides play-based speech and language activities for parents to practice with their children at home. The Service includes:
- Access to a library of speech and language activities
- Activity tracking and progress monitoring tools
- Educational content about speech and language development strategies
- Developmental guidance based on typical age-appropriate milestones
- Progress reports and data visualization
The Service is NOT:
- A substitute for professional speech pathology assessment or treatment
- Medical advice, diagnosis, or treatment
- Intended to diagnose, treat, cure, or prevent any medical condition
- A certified or regulated medical device or healthcare service
3. Important Disclaimers
3.1 Not Professional Medical Advice
ChatterPath provides general educational information and activity suggestions based on typical speech and language development. This information is not professional medical, therapeutic, or diagnostic advice.
You should consult a licensed speech-language pathologist for professional assessment, diagnosis, treatment planning, and concerns about your child's development.
3.2 Developmental Guidance
Age-appropriateness indicators and developmental milestones are based on typical development ranges. Every child develops at their own pace, and variations from typical ranges do not necessarily indicate a problem.
3.3 User Responsibility
You are solely responsible for deciding which activities are appropriate, supervising your child during all activities, your child's safety, and seeking professional advice when needed.
Safety Warning: Supervise all activities. You are responsible for:
- Selecting age-appropriate materials
- Direct supervision during all activities
- Adapting activities to your child's abilities
- Stopping any activity if your child shows signs of distress
- Checking for choking hazards in any materials used
3.4 No Guarantees
ChatterPath makes no guarantees regarding specific outcomes, timelines for progress, effectiveness of any particular activity, or suitability for your specific child.
4. User Accounts
To use certain features, you must create an account. You agree to provide accurate information, keep your password secure, notify us of unauthorized access, and be responsible for all activities under your account.
We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or abuse the Service. You may terminate your account at any time through Settings.
5. Subscription and Payment Terms
5.1 Pricing
Monthly: $12.99 AUD/month · 6-Month: $62.00 AUD (save 20%, equivalent to $10.33/month). All prices in AUD. We reserve the right to change pricing with 30 days' notice.
Auto-Renewal: Subscriptions automatically renew unless canceled before the renewal date. You may cancel anytime in Settings.
5.2 Free Trial
New users receive a 7-day free trial with full access to all features. After the trial ends, you must subscribe to continue using the Service. One trial per user. A payment method is required to start your free trial. You will not be charged until your trial ends.
5.3 Cancellation and Refunds
You may cancel at any time via Settings → Manage Subscription. Cancellation takes effect at the end of your current billing period.
Within 7 days of purchase: full refund available. After 7 days: refunds are available if we fail to meet Australian Consumer Guarantees. Pro-rata refunds are not available. Contact info@chatterpathapp.com for refunds.
5.4 Failed Payments
Failed payments trigger email notification and a 3-day grace period. After 3 days, your subscription will be canceled.
5.5 Australian Consumer Guarantees
Nothing in these Terms excludes, restricts, or modifies any rights you may have under Australian Consumer Law (ACL). Under ACL, you have guaranteed rights that services will be:
- Provided with acceptable care and skill
- Fit for the purpose for which they are supplied
- Delivered within a reasonable time
For major failures, you may cancel the service and obtain a refund. For more information about your consumer rights, visit www.accc.gov.au.
6. Acceptable Use Policy
You may use the Service for personal, non-commercial use to support your own child's development.
You may NOT: use the Service for illegal purposes, attempt unauthorized access, use automated systems, share credentials, create multiple accounts to circumvent limitations, reverse engineer the Service, or provide professional speech pathology services using the Service.
7. Intellectual Property Rights
The Service and all content are owned by ChatterPath and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license for personal use.
You retain ownership of notes, data you input, and progress information. By using the Service, you grant ChatterPath a license to process your content to provide the Service and to anonymize data for analytics.
8. Privacy and Data Protection
Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference.
9. Third-Party Services
The Service uses the following third-party services:
- Supabase (database and authentication, hosted on AWS Mumbai)
- Stripe Inc. (payment processing)
- Apple Inc. (App Store distribution)
- Google LLC (Google Play distribution)
Your use of these services is subject to their respective terms and privacy policies.
10. Disclaimers and Limitations of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
Use of the Service does not create a professional relationship. To the maximum extent permitted by law, ChatterPath shall not be liable for indirect, incidental, special, consequential, or punitive damages.
In no event shall ChatterPath's total liability exceed the amount you paid in the 12 months preceding the claim, or $100, whichever is greater.
This limitation does not apply to liability that cannot be excluded under Australian Consumer Law, including liability for personal injury, death, or fraud.
11. Indemnification
You agree to indemnify and hold harmless ChatterPath from claims arising from your use of the Service, violation of these Terms, or any harm resulting from use of activities.
12. Modifications
We may modify the Service or these Terms at any time. For material changes, we will provide at least 30 days' notice. Continued use after changes constitutes acceptance.
13. Termination
You may terminate your account at any time via Settings. We may terminate accounts for breach of Terms or at our discretion.
Upon termination:
- You may export your data at any time before deletion
- You have 30 days after termination to request a data export
- Data will be permanently deleted after 90 days
- Email reminders will be sent at 7 days and 30 days after termination
14. Dispute Resolution
These Terms are governed by the laws of Western Australia, Australia. You agree to submit to the exclusive jurisdiction of the courts in Perth, Western Australia. Before filing a claim, you agree to attempt informal resolution for 60 days.
You agree that disputes will be resolved individually, not as a class action. Any claim must be filed within one year.
15. General Provisions
These Terms constitute the entire agreement. If any provision is found invalid, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver. These Terms are provided in English.
